Calif. Court Upholds In-State Tuition Policy

"The state Supreme Court on Monday upheld California's practice of allowing illegal immigrants to pay in-state fees at public colleges and universities," the Fresno Bee reported.

"Had the high court ruled the law unconstitutional, the University of California and California State University systems would have been forced to repay out-of-state fees to thousands of students from other parts of the nation."

"'California has managed to find a loophole in federal law,' [FAIR spokesman Ira Mehlman] said, noting that AB 540 is costing California taxpayers millions of dollars in lost revenue. Meantime, state officials hike college fees and cut admissions. 'While the law benefits illegal immigrants, it is inflicting pain on everyone else.'"
