Alabama Seeks Re-Hearing on Challenge to Immigration Law
"Calling the 11th Circuit Court of Appeals rulings on Alabama's immigration law last month "important and wrong," state officials filed a motion Monday asking for a rehearing on provisions of the controversial immigration law before the entire court. Last month, a federal panel of judges from the court found provisions of the law unconstitutional, including one requiring schools to check the immigration status of students at time of enrollment. The panel of judges said that violated the Equal Protection Clause of the 14th Amendment to the U.S. Constitution The state disagrees and is seeking a rehearing before the entire 11th Circuit Court of Appeals on the law, known as HB 56," the Montgomery Advertiser says.
