Supreme Court Ruling Gives Non-Citizens Right to Immigration Advice in Criminal Cases The Supreme Court ruled today that the Sixth Amendment right to effective counsel includes informing non-citizens of the immigration consequences of guilty please in criminal cases. A legal immigrant who pled guilty in a drug case said that his attorney falsely informed him that the plea would not impact his immigration status. Several justices dissented from the ruling, noting that since any immigration fallout from a guilty plea was one of the "collateral consequences of conviction", defense attorneys should not be required to discuss it. Arizona Politicians Call for Guard, Military at Border After Rancher Killed Arizona Governor Jan Brewer, along with Rep. Gabrielle Giffords, Sen. John McCain and former Rep. J.D. Hayworth have all called for National Guard and other military units to be stationed along the Arizona-Mexico border. The slaying of rancher Robert Krentz is believed to have been done by an illegal alien, since tracks at the crime scene led back to Mexico and Krentz indicated he had found an illegal immigrant in his last radio transmission. "I urge you to take bold and immediate action to protect our citizens by deploying the National Guard to our southern border," Giffords said in a letter to President Obama. Thinking Through the Plan for Amnesty Victor Davis Hanson outlines how the Obama administration is likely to try to pass amnesty - using a playbook similar to the one for health care. College Course Gets An 'F' for Smearing Hazleton Professor Lori Zett at Temple University is facing criticism for teaching a course called "War in Hazleton: Main Street Meets the Global Village." Rancher Killed Along Border Robert Krentz, a rancher near Douglas, Arizona, was found shot to death this weekend. Krentz had spoken out about the dangers of illegal immigration years ago. Former Rep. ICE Promises More Deportations, Number Removed Sank Dramatically Under Obama The Washington Post says that ICE leaders, facing a dramatic drop in overall deportations -- over 20 percent -- are moving to increase enforcement against illegal immigrants by increasing detention space, more prison and jail sweeps to find illegal immigrants, and looking for illegal aliens who lied on visa or other applications. "We cannot allow a preoccupation with criminal aliens to obscure other critical ICE missions," Rep. Harold Rogers (Ky.) said in a statement. "At best, it appears as though immigration enforcement is being shelved and the Administration is attempting to enact some sort of selective amnesty under the cover of 'prioritization.' Informant Escapes Deportation As Panel Rules Mexico Too Corrupt to Return To An illegal alien who served as an informant escaped deportation after a federal immigration board approved his appeal. Nebraska Debates Pre-Natal Care for Illegal Immigrants After Federal agencies told the state that it could not cover pregnant illegal aliens under Medicaid, illegal alien support groups expected an easy path to getting state funds. They were wrong, as Nebraska Gov. Dave Heineman helped stop the move to give away tax dollars to illegal immigrants. Arizona Bill to Toughen Immigration Enforcement Advances "The Arizona Legislature gave preliminary approval Tuesday to a proposal that would allow the police to arrest illegal immigrants on trespassing charges simply for being in the state," according to the New York Times. "State Senator Russell Pearce, a Republican and the chief sponsor of the legislation, brushed aside concerns raised by civil libertarians that the law would open the door to racial profiling. The local office of the American Civil Liberties Union says the bill is unconstitutional. Mr. Pearce said the bill gives the police another tool and compensates for lax enforcement of immigration law by the federal authorities. The police, he said, do not have to arrest every illegal immigrant on trespassing charges, but it gives them that discretion." March 24, 2010
DHS Would Be Overwhelmed by Amnesty "The federal government is not equipped to process the flood of applications from a proposed immigration legalization bill and the agency that would oversee that program won't be ready for 'a few years,' the office of the Homeland Security Department's inspector general told Congress on Tuesday," the Washington Times reports. Former DHS Official Convicted in Illegal Nanny Case "A former official for the US Department of Homeland Security was convicted today of encouraging her illegal immigrant housekeeper to remain in the country. The verdict came more than a year after Lorraine Henderson, 52, was arrested on a federal charge and suspended without pay from her $140,000-a-year job as Boston port director for Customs and Border Protection," the Boston Globe reported. "Henderson testified she did not know that Fabiana Bitencourt, who is from Brazil, had paid $10,000 to be smuggled into the United States in the summer of 2001 when she hired her in March 2004 to clean her two-bedroom Salem condominium." Duluth Immigration Attorney Sentenced for Fraud "A Duluth attorney was sentenced Monday to federal prison for helping clients commit immigration fraud. Sai Hyun Lee, 63, pleaded guilty in November to filing false documents with the federal government, according to the U.S. Attorney's Office for the Northern District of Georgia," the Atlanta Journal Constitution reports. Amnesty Legislation Faces Familiar Roadblocks The Christian Science Monitor says that amnesty supporters face a familiar set of tradeoffs in trying to get a bill passed, including demands by businesses for a guest worker program. FAIR spokesman Ira Mehlman noted that Obama's decision to revive amnesty this year is tied to the health care debate. To Give Out Crime Victim Visas "Immigrants who have been victims of crimes and help authorities prosecute perpetrators can now get help from the U.S. Labor Department with their applications for a special type of visa. Investigators of workplace violations have been authorized to certify applications for a U visa to stay in the country, U.S. Labor Secretary Hilda Solis said," the AP reports. "To qualify for the visas, immigrants have to show they suffered a specific crime such as sexual assault or being forced to work without pay, and show they helped law enforcement in their investigation." Napolitano Yanks Virtual Fence Funds "Signaling a major shift from her predecessor, Homeland Security Secretary Janet Napolitano on Tuesday said she will spend $50 million of stimulus funds originally intended to build a 'virtual fence' along the 2,000-mile U.S.-Mexico border on other more proven and cost-effective security technology," the Washington Times reported. "Newly arriving immigrants are likely to settle where there are job opportunities and affordable places to live," says Ira Mehlman, spokesman for the Federation for American Immigration Reform. "It also dispels one of the key assertions of the immigration enthusiasts [who] often look at the fact that immigrants tend to congregate in areas of the country where the economy is most robust, and conclude that immigration is the cause of economic growth. New Haven Mayor Proposes City Fund ID Cards for Illegal Immigrants "Grants that paid for the first three years of the Elm City ID card have dried up, and, for the first time, Mayor John DeStefano Jr. is proposing that the program be paid for with general funds," the New Haven Register reports. "The city has offered the identification cards to residents, regardless of immigration status, since 2007. For Health Insurance "Massachusetts' landmark 2006 comprehensive health system reforms hit another hurdle after a group of legal immigrants who were excluded from Commonwealth Care coverage in the wake of last year's budget cuts sued authorities overseeing the program. As other states look to similar cost-saving cuts, the case raises questions over how to address a growing legal immigrant population and the health costs associated with the largely uninsured group," the AMA reports. The suit is based on equal-protection arguments. "'What the federal government was trying to do was prevent incoming immigrants from immediately having to rely on public coffers ... and [Massachusetts] is just coming on par with federal law [the 5 year ban on welfare],' said Dustin Carnevale, a spokesman for the Washington, D.C.-based Federation for American Immigration Reform, a nonprofit organization that supports reduced immigration levels. Dairy Lobby Wants Cheap Labor, Access to Guest Workers Gervais Family Farms in Vermont is among the dairies asking for special treatment and a license to bring in cheap foreign workers. Clement Gervais spoke to the AP after his business was audited and found to have hired 3 illegal workers. "With 950 cows that need to be milked three times a day, Gervais said he's struggled to find reliable workers. Many apply only when they can't find work elsewhere. They often have drug or alcohol problems or troubles at home, he said. He pays his staff $10 to $12 an hour, but said milking can be monotonous and not everyone enjoys it or is good working with animals," the AP reported. "There's not enough people that want to do it. That's the real, true issue," Gervais said. "I mean there's good Americans that can milk, but there's not enough of them that can and want to." And in Wisconsin, dairies are also lobbying for more cheap foreign labor, that we all pay for. "Dairy farmers say they want access to workers without getting in trouble. Many say they could go out of business without immigrant labor and consumers would likely end up paying more for milk," Capitol News Connection reports. "Immigrants now make up about 40 percent of the state's dairy labor force, up from 5 percent a decade ago, according to a 2009 study by the UW-Madison Program on Agricultural Technology Studies. Many of the workers are in the United States illegally." The bottom line is: 10 years ago 95 percent of dairy workers were Americans. Now, these businesses have become dependent on the cost advantage of cheap foreign workers and want to legalize this displacement of American workers. March 12, 2010

Raids Focus on Restaurants "Twenty-nine people were taken into custody by U.S. Immigration and Customs Enforcement officials in simultaneous raids Thursday morning in Anne Arundel and Baltimore counties at two restaurants, several residences and an office," the Baltimore Sun says. "One of the raids focused on the Timbuktu Restaurant in the 1700 block of Dorsey Road in Hanover and several nearby homes where restaurant workers were housed, according to Anne Arundel County Executive John R. California Man Helped Dozens With Student Visa Fraud Dozens of foreign students from Middle Eastern countries paid Eammon Daniel Higgins hundreds of thousands of dollars to attend classes and take exams for them, authorities say. "Students paid up to $1,500 for course assignments and finals and about $1,000 for English and writing proficiency exams, prosecutors allege," according to the LA Times. "[T] the case raises questions about whether the government has let its guard down since the Sept. 11, 2001, terrorist attacks, when one of the hijackers was in the U.S. on a student visa, said Ira Mehlman, spokesman for the Federation for American Immigration Reform. 'This is an indication that a lot of the abuses that led to 9/11 are still taking place,' Mehlman said. 'The consequences are not just people getting phony grades. Greece Added to Visa Waiver Program Despite Economic Problems "Department of Homeland Security (DHS) Secretary Janet Napolitano today announced the designation of Greece as a member of the Visa Waiver Program (VWP)--strengthening passenger information sharing and ensuring strict security standards while streamlining travel for Greek citizens visiting the United States," DHS said in a news release. "It makes no sense to expand the Visa Waiver program until the exit portion of U.S.-VISIT is fully implemented. Without an exit tracking system, visitors to the U.S. can stay here indefinitely and undetected," noted Rep. Lamar Smith (R-TX) in response. "Without a fully-implemented exit program, the VWP facilitates illegal immigration. Jobless Rate Spikes in Nevada "Pushed by seasonal layoffs that follow the Christmas season, Nevada's unemployment rate rose nearly a percent to 13.7 percent in January. Audits Target Companies in Five States "As part of the government's new immigration enforcement strategy, 180 businesses in five states, including Tennessee, will be audited to make sure they are not hiring illegal workers," the Times Free Press reported. Expected Flood of Haitian TPS Applicants Yet to Show ABC News says that the expected flood of TPS applications from Haitians hasn't happened yet. "Only 10 percent of the estimated 200,000 Haitians living in the United states illegally have taken advantage of a controversial Obama administration initiative that would allow them to live and work freely here until conditions in Haiti improve." The story notes that many Haitians here illegally don't want to sign up for TPS because they don't want the government to know they are here illegally. Haitians appear to take the TPS program at face value, and not as the permanent amnesty it has become in permanent practice. Senate Amnesty Bill May Include Secure ID "Lawmakers working to craft a new comprehensive immigration bill have settled on a way to prevent employers from hiring illegal immigrants: a national biometric identification card all American workers would eventually be required to obtain. Under the potentially controversial plan still taking shape in the Senate, all legal U.S. workers, including citizens and immigrants, would be issued an ID card with embedded information, such as fingerprints, to tie the card to the worker," the Wall Street Journal says. Investor Programs Offer Expensive Route to Green Cards "You've got half a million dollars. You crave the American dream. May I interest you in a green card? This may sound like a back-alley deal, but this is the arrangement thousands of wealthy foreigners have made with the U.S. government. The EB-5 visa offers a path to citizenship in exchange for investing in an American business. The numbers of these types of visas issued in the past two years have tripled, and around half of the visas are being snatched up by wealthy Chinese," NPR reports. The Migration Policy Institute: Give Us E-verify - Just Not Yet Marc Rosenblum with the Migration Policy Institute tells Dallas Morning News readers that since E-Verify isn't perfect, public concern about illegal immigration should be shelved until even more pilot programs can be tested. "Mandatory E-Verify without broader immigration reform may produce more identity theft and off-the-books employment," warns Rosenblum. Rosenblum remains silent, however, on the subject of REAL ID, which was the most recent attempt to combat identity fraud and drew directly on the 9/11 commission report. At the end of his op-ed, Rosenblum says "Effective employment eligibility screening will be the linchpin of any successful immigration reform, and it is essential that we create the conditions for it to succeed by finding the right model for verification and by linking enforcement to broader immigration reforms." Florida School Implicated in Visa Fraud Ring "A Florida language school helped illegally obtain student visas for foreign nationals who never went to class, violating laws enacted after the Sept. 11 terrorist attacks exposed weaknesses in the program, authorities said Thursday," the AP reports. NYT Decides to Recycle Greenspan on Social Security and Immigration Catherine Rampell with the Economix blog at the New York Times recycles the same discredited logic used by Alan Greenspan in the 1990's when he first floated the idea that more immigration would have an impact on Social Security's solvency. At the time, FAIR produced a publication, A Ponzi Problem: The U.S. Dependency Ratio, Social Security Solvency and the False Panacea of Immigration (2000). "Part of what has saved the United States from some of the entitlement-funding problems plaguing our peers in Japan and Western Europe is immigration, says Stephen Ansolabehere, a professor of government at Harvard. "Immigrants are younger than the typical American," Professor Ansolabehere told me in an interview about the long-term fiscal challenges facing the United States. "These people are entering the work force and paying taxes, Social Security taxes, that sustain these programs." As comments at the NYT site pointed out, "At least some of those immigrants are displacing American workers. So even if the immigrant is paying taxes, they aren't adding to the tax base - they're just paying into the tax base while the American worker is not. And also, immigrants have pushed down the average wage for many jobs." And, "If Social Security requires an ever-growing population of new workers to remain solvent, then it is a pyramid scheme. Oklahoma Appeals Decision on Immigration Law "[Oklahoma] has asked the full 10th U.S. Circuit Court of Appeals to reconsider a decision against key parts of Oklahoma's stringent immigration law," the Oklahoman reported. Among other provisions, "The law bars an employer from firing workers who are U.S. citizens while retaining workers who are illegal aliens." The court upheld some provisions of the law, but not all. That's how many times the anti-illegal immigration crusader has attempted to pass legislation that would require Colorado employers to use the federal E-Verify system. That vague threat carries less clout with most members of Congress than the letters they get from angry constituents -- and two polls late last year found that about 60 percent of U.S. citizens oppose any form of legalization for illegal immigrants." "Some national groups advocating reduced immigration contend that the United States faces unsustainable population growth, due in part to illegal immigrants, that would lead to greater unemployment for legal workers," the Medill News Service reports. "The whole society is negatively affected by population growth that can't be controlled," said Dave Gorak, executive director of the LaValle, Wis.-based Midwest Coalition to Reduce Immigration. New Birth Certificates for Puerto Ricans to Combat Immigration Fraud "Puerto Ricans are already getting greater scrutiny because of America's vexing and often hysterical immigration debate. As motor vehicle departments have gotten into the business of checking people's immigration status - especially people with Spanish surnames and/or accents - Puerto Ricans are often asked for 'green cards' they, of course, don't have," says Douglas Rivlin at Alternet. "Here's an idea: What if the United States had a functioning legal immigration system that allowed people to come to the U.S. with visas within reasonable limits and within reasonable time frames? . . . Maybe then we wouldn't have such a huge black market for false documents and wouldn't have to twist ourselves in knots with workarounds like invalidating millions of birth certificates." Poor Choices Led to Deportation, Not ICE's Action The San Francisco Chronicle has the story of one family used as an example by immigrant groups to attack the change in San Francisco's sanctuary policy for illegal alien juveniles. "On Friday, Tracey Washington and her two children are scheduled to be deported to Australia for staying in the United States after their legal status expired in May. They applied for legal residence in December based on her marriage to a U.S. citizen, but a lawyer said those hopes were doomed by the 13-year-old's schoolyard folly and the city's crackdown," the Chronicle reported. After dwelling on the emotional impact of the deportation, the Chronicle finally recounts why Ms. Washington faces deportation - "Tracey Washington arrived on a visa waiver in February 2009 to be with Charles Washington, whom she had met on a U.S. visit six years earlier. The visa waiver system is in place for temporary visitors - not fiancés and not people planning on living in the U.S. permanently. Since the Obama administration wants the Visa Waiver program expanded, expect more stories like this where the system is abused and then the person who broke the law says the punishment is unfair. Obama Administration Says Enforcement Ramping Up Against Criminals "The nation's top immigration cop said Friday that the Obama administration is stepping up enforcement against immigrants who commit crimes and will move aggressively against employers who hire unauthorized labor," the Dallas Morning News reported. A Look Inside ICE Detention The Brownsville Herald profiles one immigration detention center at Port Isabel, Texas. "As the administration of President Barack Obama undertakes a comprehensive review of the nation's immigration detention policies -- pledging to address the varied backgrounds and situations of its wards -- centers like Port Isabel remain in transition," the paper says. "The facility -- one of the largest ICE-managed detention centers in the country -- houses a population made up of 86 percent criminal aliens, an agency-designated term used to describe undocumented migrants who have also been convicted of crimes while in the United States. As a result, detainees remain housed in locked-down pods, they eat their meals and watch television under guard, and all are escorted from building to building amid rows of fencing and barbed wire. H-2A Changes Boost Ag Worker Wages "Changes to the federal guest worker program, which will kick in next month, could leave farmers shorthanded with both their labor force and their profits," Highlands Today says. "The changes would increase agricultural workers' minimum wage from $7.25 to $9.21 an hour and require that employers hire all interested domestic workers first. But growers say domestic workers are not a dependable workforce and they face losing money and crops." "Although the new ruling doesn't change [exempting agriculture workers from overtime], it does improve the working conditions for both U.S. and migrant workers and gives governmental agencies more oversight to prevent abuses and worker violations," noted one farmworker advocate. |
