Success for the Programmers Guild John Miano, founder of the Programmers Guild, has long been pursuing legal action against This is another example of foreign workers taking jobs from American citizens. It is about time something was done to help correct the situation. Posted by: Rick S on May 5, 2008 07:41 PMI think the big money "LEGAL IMMIGRANTS" should be scrutinized the most. I am back too bad nothing has changed except more importation of competition, I firmly believe that Hillary is better than Mccain on immigration this is coming from a person that formely donated to the GOP until traitors took over it Posted by: impeachbush on May 5, 2008 11:18 PMI appreciate the efforts of the Prog. Guild, but I am afraid that the Feds are only giving us a few crumbs of bread with this judgment in order to fool the public into thinking that they are serious about the economic well being of working Americans. There are a number of bills in Congress that would double or triple the number of H1B visas and even one by Zoe Lofgren that would increase the number of employment greencards. If any of these bills pass then more citizens will lose their careers, as the law allows most employers to freely replace citizens with H1B people at will, even if the citizens are performing well in their jobs. Once the H1B-ers get those precious greencards, then the displacement of Americans becomes permanent and self-perpetuating. I have seen a lot of anti-American discrimination in the companies that I have worked for, much of it coming from foreign managers who are former H1B visa workers that got their greencards and were granted legal perm resident status. Also, I have yet to meet an H1Ber-turned-greencard-holder that is even remotely interested in becoming a US citizen. You see, these obnoxious parasites want all the privileges and comforts of living in the US with NONE of the responsibilities of citizenship. These are good reasons to shut down the EB greencard program as well as the H1B racket. Karl, Name-calling again? Typical desperate last measure of pathetic old losers..why do you want EB greencard holders to become US citizens suddenly? All this time, you and your fellow losers didnt even want the H1-bs to get a GC?? Applying for a Greencard or applying for a citizenship are all personal reasons that one chooses to do...many GC holders do ultimately go and apply for citizenship after the mandatory five years on the GC. Probably you wouldnt dont anything either about the rules or the EB GC holders themselves, so just shut your pie-hole up and do more research before shooting your a** off... People like you have been getting jobs in hi-tech because of innovation of foreign born entrepreneurs..and now you turn back and call them obnoxious parasites? look at the nerve..disgusting trailer-trash ingrates! No wonder all the smart foreigners are stealing your jobs, coz you are mostly worthless! Posted by: boreal on May 6, 2008 12:00 PMITS CALLED GREED AND PANIC Grab all the money while you can, to Hades with America. Posted by: Softwarengineer on May 6, 2008 12:06 PMRacist Boreal and his ilk can`t stand the fact that H-1B is a scam, and everyone knows it. That`s why they always resort to name calling, because they have no facts to ever debate, just propaganda.
For Karl: Look for responses to your blatant lies below. "There are a number of bills in Congress that would double or triple the number of H1B visas and even one by Zoe Lofgren that would increase the number of employment greencards. " Zoe Lofgren's bill would RE-CAPTURE all greencards, which were not allocated to their rightful owners due to USCIS's slow processing. USCIS could not allocate all 140k greencards marked for allocation each year due to slow processing and so wasted them. Due to this, there is a backlog of a large number of g-cards. Zoe is just trying to re-captute and allocate them so that the backlog is taken care of. How can it be called an "increase" in greencards. Explain to me.
Did not your ancestors displace US workers at their times? You s'd respect H1-Bers as they are invited by businesses as they are required and are smart unlke you who are whole day sitting here writing racist xenophobic comments. Go get some skills to get a job. Else, you 'll die cursing hard-working, intelligent, honest , and legal H1-B people. "Also, I have yet to meet an H1Ber-turned-greencard-holder that is even remotely interested in becoming a US citizen. " And, I have met very few H1Ber-turned-greencard-holders who are NOT interested in becoming a US citizen. Even if they are not citizens, which BTWtakes 5 damn years, they behave like better citizens than many of you. Tell me about 1 H1Ber-turned-greencard-holder, who does not pay taxes or gets unemplyment benefit. In fact, they feed lazy people like you, who want lot of money w/t much work. Get over it. World is chnaging very fast. Become skilled and hward-working, else no body in this world is obliged to feed you w/t any work. Whining and moaning won't do anything. If possible, learn how to work hard from these H1-Bers. One good thing about all of this is it sets a president that can be used in future legal actions against employers who abuse the h1b visa system. Brian Posted by: Brian on May 6, 2008 04:54 PMBOREAL IS A FOREIGN POLITICAL ACTIVIST. Based on the screen name and some posts on other websites, I have good reason to believe that Boreal and some of the other arrogant H1-B hacks who post here are part of an unsavory group called Immigration Voice. For those of you that don’t already know, Immigration Voice is a political activist group, made up of mostly Indian and other Asian H1-Bs who work in high tech and other professions, whose main purpose is to lobby the Federal Government for drastic increases in green cards and other changes that would allow far greater numbers of third world foreign workers to easily and quickly attain permanent residence in the U.S. They have even hired professional lobbyists to help them accomplish this goal. Boreal and the other members of the Immigration Voice group LOOK UPON ALL AMERICAN CITIZENS WITH DISDAIN. Several of the H1-B workers that I work with actually are contributing members of the Immigration Voice group, and they regularly talk about re-making society and the corporate culture in America to their liking. Most of them want to get green cards and eventually move into management roles so they can set their own rules for who gets hired and fired. TRANSLATION: THEY WANT OUR GOVERNMENT TO APPROVE AS MANY GREEN CARDS AS POSSIBLE SO THEY CAN IMPORT AS MANY OF THEIR FRIENDS AND RELATIVES AS POSSIBLE TO ELIMINATE AMERICANS FROM A WIDE VARIETY OF PROFESSIONS – NOT JUST HIGH TECH! Remember that H1-B is a dual intent visa. That means the foreign workers can apply for a green card while they are here on H1-B. Once they get the green card, then they become permanent residents and are almost impossible to deport. MORE GREEN CARDS MEANS MORE ECONOMIC DISPLACEMENT AND MISERY FOR MILLIONS OF AMERICAN WORKERS AND MORE LOST CAREERS FOR AMERICAN COLLEGE STUDENTS. On the other hand, IF WE PUT A MORATORIUM ON GREEN CARDS THEN MOST OF THE H1-B WORKERS WOULD PROBABLY GO HOME, THUS IMPROVING THE WAGES AND WORKING CONDITIONS FOR AMERICANS. Politically speaking, we citizens had all better get it in gear and build up OUR organizations, because I can guarantee that none of us want to live in the economic and cultural environment that Boreal and other H1-B hacks and their employers have planned for us. This programmer guild sounds like a group made up of non-producing socialists. Only an isolationist organization like FAIR would hail such people as heroes. I really admire the high tech guestworkers. They are smart, productive, and mentally tough. I would much rather have them on my team than the home grown socialists. Posted by: Purpose Driven Exec on May 7, 2008 07:24 AMBoreal and Independent, your posts are total LMAO material as usual. So what if Lofgren’s bill says that it recaptures unused greencards from the past? It still makes more greencards available. More greencards means more fraud, like the kind shown in the *How not to hire an American* video on YouTube. In this video, lawyers from the Cohen & Grigsby law firm demonstrate how they help employers game the hiring laws and disqualify even highly qualified American job seekers using legal technicalities, just so H1B people who are already working in those jobs can get greencard sponsorship. Any increase in EB greencards or H1B visas results in job displacement and career loss for Americans, so it doesn’t matter if those visas are designated as *new* or *recaptured*. The effect is the same either way. H1B people like to brag about how they are supporting Americans thru payroll tax and Social Security tax deductions. This is a ridiculous claim on its face, since studies by the Center for Immigration Studies and Dr. Norman Matloff have shown that H1B depresses wages in the industries that use the program. Depressed wages means a decreased tax base. So even though the H1B people may be paying taxes, their presence here means less tax revenue is going into the federal Treasury, in the present and in the future. No other country in the world has a system that allows foreign workers to be arbitrarily substituted for skilled domestic workers. If such a system were in place in India or the Middle East, for example, there would be massive protests and possibly rioting in the streets. Boreal and Independent, please keep posting your rants here. The obnoxious attitudes evident in your writings are the very best reason to shut down both the H1B and EB greencard programs. FYI, I do actually have a professional job and good skills, and I am fighting to hold on to what I have earned, and I will continue to do so. Thanks for giving me more fuel for my fire! HEY SOCIALIST PDE, GET YOURSELF A ONE WAY TICKET To India, where all your H1-B buddies reside. Its socialist to bring in hoards of poor into America PDE, but its democratic to follow the will of the voters and support depopulation and the environment, like FAIR does. You got your politics all messed up, but that doesn't surprise me at all, coming from the likes of your greed crowd. Posted by: Softwarengineer on May 7, 2008 11:14 AMPurpose Driven Exec, like you, I'm a corporate executive, but I'm also an entrepreneur. I've also been a Fortune 500 executive in the past. As the CEO of a fast-growing business, I always welcome competitors such as yourself who toe the party line, persist with a cost mentality, and fail to see the larger picture. It's the innovators and creative risk-takers who flourish, not the self-described executives (e.g., Purpose Driven Exec) and managers, who generally have done a poor job running this struggling economy. The adjectives you employ reveal much about your values: smart, productive and mentally tough just doesn't cut it in my company. Why? Anyone I hire, whether internal or external, needs these attributes as a base-line; it's all assumed. What I'm after are people who are creative, think outside the box, and not "productive," but effective. Do you understand the shade of difference here? If not, let me explain. A productive employee delivers set results against given criteria at a certain cost-time input. This is a 1930s-style measure of output as you mean it. I don't establish set criteria and my workers don't punch a time clock. Instead of worker drones, I only hire tech workers who employ something strategic in areas that will expand the company's success. They might even be part-time consultants who are not "productive" in terms of measurable, short-term results. As Amazon founder Bezos recently noted to an executive when asked how much he would spend on developing Kindle, his reply was, essentially, "How much do we have?" Innovators such as Bezos and Steve Jobs are not, unlike Indian outsourcing firms and yourself, in the front of the line for imported tech workers. Posted by: Concerned Citizen on May 7, 2008 11:19 AMIndependent dependent(on the U.S.) Zoe Loftgren is a well known traitor in California, who has never had the U.S. Citizens living in California's best interests at heart in anything. Big deal. Posted by: Bobby on May 7, 2008 04:59 PMConcerned Citizen, do you mean to say that you actually run a business by paying people who do not produce any measurable or quantifiable benefit for your company? Really now, just try taking that business model to a venture capitalist or private equity group and see how far you get. I get the impression that you and Mr. Software would like to live in an America where there is no immigration, no outsourcing, and rank and file employees get paid 50$-60$ per hour for doing very little work with plenty of benefits and lots of time off. Dream on! I’ve got news for you, most of the investment capital that makes this economy run currently comes from the Middle East and Asia. Do you think those investors are going to waste money on a leisure time oriented economy with bloated salaries for under performing workers? No way! The only way that the domestic economy can stay afloat in this competitive new world is to boost productivity and lower costs. And yes, labor is a major cost. Importing mentally tenacious people to do high tech jobs in a cost effective manner is a no brainer. You better start learning to speak Hindi and Mandarin. Purpose Driven Executive, I get the feeling you would like to live in an America that supports unlimited third world immigration of uneducated, tax payer dependent, poor. I'd rather go with Concerned Citizen and Software, than the choice you give me. Heath Shuler (D-NC) is scheduled to appear at the hearing.) Posted by: American Me on May 5, 2008 12:29 PMThe irony in all this is that the Congress wants to see a cost benefit analysis for employers but is not particularly keen to do a cost benefit analysis for the rest of us. The better question to ask is what is the cost of not doing it? Posted by: hugo on May 5, 2008 01:17 PMThere is no need for a "cost estimate"... I will happily support this effort...all employers must be held accountable and e-verify must be made mandatory! Posted by: takn on May 5, 2008 03:03 PMOnce again I must ask, "what is it that our politicians (who work for us because we put them in office) do not understand about 'ILLEGAL'"? We are the ones who (for lack of a better term) put them in office and if they do not represent US then WE should get them out of office. For that matter, if they are not doing what they swore to do when they took office, they should resign their office. Problem is that we won't ever see that! Posted by: Sick 'n Tired on May 5, 2008 04:03 PMThe "open border carzies" will always find a reason not to do the right thing. These politicans represent illegal aliens not American citizens. They don't want to protect American jobs or American taxpayers burdened with the costs of benefits for illegals. Posted by: Rick S on May 5, 2008 04:42 PMHere we go again same thing differant day. Posted by: ALOHA on May 5, 2008 06:31 PMthe illegal alien lobby is too strong to win Posted by: impeachbush on May 5, 2008 11:19 PMThis is total bull****. Below is taken from the home page for E-Verify and clearly states its a free service so how is there any cost to the employer other than an employer taking 10 minutes out of his day to verify new hires? Dan Stein, you should point this out the next time you're on CNN. Brian "E-Verify (formerly known as the Basic Pilot/Employment Eligibility Verification Program) is an Internet-based system operated by the Department of Homeland Security in partnership with the Social Security Administration that allows participating employers to electronically verify the employment eligibility of their newly hired employees. E-Verify is free and voluntary and is the best means available for determining employment eligibility of new hires and the validity of their Social Security Numbers." Posted by: Brian on May 6, 2008 10:33 AMOur politicians are just doing nothing to justify their existence in Washington. They are just there to collect their paychecks and to feed B.S. to the American Public. What will be the breaking point in all this? At what point will the American Public finally say we have had enough or as was the line in the movie "NETWORK", "I'm Mad as hell and I'm not going to take this anymore." I find it so difficult to believe that these "Americans" are allowing this to happen right under their noses and these are the same noses that are snubbing the very people who put them into the office they have. Every one of them should do the honorary thing and resign for incompetence and failing to honorably discharge the duties of their office - and for failing to uphold the laws of the United States and the Constitution. Posted by: Sick 'n Tired on May 6, 2008 11:43 AMThe problem is politicians like Kathy Currie as an example who rule in favor of legislation that personally benefits their own investments. Some of these politicians who are in favor of pushing the illegals demands are supporting, not only their personal investments but the demands of corporations who are benefiting from the illegal workers. American Citizens are dismissed entirely. Were no longer being represented and that is a serious problem. I know of employeer's who are now sending letters to long term citizen employee's, telling them per Homeland Security their documents have expired and to prove who they are but they do not say what document their referencing. Bottom line employeer's don't want to disrupt their profits or bother with the short man hours needed to simply enter and verify the data. They refuse to be held accountable and thats also a very serious problem. Politicians, corporations plus illegals are profiting in this income how dare we disrupt that. Why cant they be held accountable? The voting them out of office theory is just not working. There has to be another legal course to follow to show were serious about our stance in regards to our laws and their sworn accountability to their office in up holding those laws. Posted by: Jane on May 6, 2008 12:01 PMTAKN AND I ARE BROKEN RECORDS ON THIS ISSUE We keep repeating: "Just enforce existing laws, just enforce existing laws, just enforce existing laws, ....etc, etc...." Posted by: Softwarengineer on May 6, 2008 12:09 PMJane, There are currently laws on the books that came out of the 1986 amnesty that require employers to verify employment status of current and new employees. Like the federal laws concerning illegal immigration these laws too are being ignored. I remember when I was in high school that McDonald's validated my social security number so when they say they can't do it today I know it's total BS. Biran Posted by: Brian on May 6, 2008 05:17 PMEnforcement Against Employers Who Knowingly Hire Illegal Workers Recently an increasing number of actions by ICE against employers of illegal aliens have been reported. The number may not yet be great enough to effectively deter other employers from engaging in similar activities, but the increased enforcement is encouraging. A recent example of this trend is reported in the Norfolk, Virginia Daily Press. According to a May 1 story, “Yvonne Michelle Peabody, 35, of Hampton -- in charge of daily operations at Peabody Corp., which runs scallop boats from a city-owned dock at the end of Jefferson Avenue -- was ordered to serve three months behind bars, starting May 15.” In addition, the privately owned company was ordered to pay a fine of half a million dollars in addition to $6.25 million in forfeited gains from hiring the illegal workers. And this should be heightened and headlined to let other employers know that there are bars waiting for them and many dollars in fines to be paid. ICE could be paid from the fines of these employers who illegally hire illegals. Make 'em pay! Posted by: Sick 'n Tired on May 5, 2008 12:05 PMNO ILLEGAL JOBS, NO ILLEGAL ALIENS! Posted by: American Me on May 5, 2008 12:30 PMIt is refreshing good to hear of one case where they charged the crime boss employers. This is not the end, it is not even the beginning of the end...but it might be the end of the beginning! Posted by: HAD IT on May 5, 2008 01:03 PMWe need to change the laws to say that only wages of employees that have been subject to e-verify qualify as deductible on State and Federal Taxes. That would make it more expensive to hire illegals not less expensive. Simple economics. Also, we need to have progressive fines. This would drive the bad apples out of business if they did not clean up their act. Take the money collected and reinvest it in the auditors. Do continous follow ups on the ones who have been caught previously and pretty soon the problem is solved. Posted by: hugo on May 5, 2008 01:24 PMSorry, but I'm still not in the camp that believes there really employers who "unknowingly" hire illegals... There has been far too much happening that employers don't know about the e-verify system so I tend to say, fine them no matter what. If they did unknowingly hire them and get hit hard once, they will be far less likely to make the same mistake again! I agree with "takn". If Pedro or Maria don't speak any English (and then not be able to produce a Social Security Card)then I would think that the employer could take a guess and say they are not legally here. If the employer runs an e-verify on Pedro or Maria then he would find out if the social security number they provided was valid or not. Pretty 'cuty 'n dried' from what I see. As for the having to hire illegals - try hiring legal immigrants. They still might need a job - since illegals took their work. ABSOLUTELY NO SYMPATHY FOR EMPLOYERS WHO HIRE ILLEGALS AND GET CAUGHT. Posted by: Sick 'n Tired on May 5, 2008 03:00 PMIgnorance of the law is not a justifiable argument. Unknowingly, as well as knowing hiring illegal aliens should be against the law. It is incumbent on the employer to determine the validity of the documentation of the employee, not the government. If the fine is substantial enough, that illegal employer will make it his first priority to establish the legality of the perspective employee prior to hiring. Illegal employers can no longer hide behind the argument that they had no way of determine the validity of the documentation. The E-verify program is easily accessible by employers and there is no excuse not to use it. Posted by: Bob Hubble on May 5, 2008 03:14 PMEnforcement, with very hard consequences like jail time and huge fines is actually what immigration law resulting from the 1986 amnesty, mandates. The only debate should be why this isn't carried out across the nation. Posted by: Bobby on May 5, 2008 04:41 PMWith e-verify there is no reason that illegal aliens should be given American jobs. Enforce existing laws! Throw all employers of illegals in jail and let them pay heavy fines. Also, we should stop all immigration until it is no longer necessary to push "1" for english. I see on the news today Mrs. Bush is pledging more of middle class Americans dwindling bank accounts to give to what use to be called third world ruled Burma to rebuild after their natural disaster. We can locate more third world refugees to America as there is now more room for the handful of illegals who supposedly have left- I'm sure none will be relocated to Bush's sprawling Texas ranch or Teddy's posh digs up in Hyannis Port.
