USA Today Op-Ed: Stop the H-1B Feeding Frenzy of Corporate Greed

"Today we are watching an amazing spectacle: Many in Congress -- including allegedly labor-friendly Democrats -- are pushing to increase the importation of foreign labor just as the USA slips into what may be its worst recession in decades. Why? Because the greed of a handful of multinationals is demanding more and more access to 'skilled' foreign labor," says FAIR president Dan Stein in a USA Today op-ed. "Sure, we hear bogus 'studies' that claim garden-variety foreign programmers will save the U.S. economy. But former Federal Reserve Chairman Alan Greenspan recently admitted the real agenda: 'Significantly opening up immigration to skilled workers … would compete with high-income people, driving more income equality.' In 2007, he further opined that, 'Our skilled wages are higher than anywhere in the world. If we open up a significant window for skilled (foreign) workers, that would suppress the skilled-wage level and end the concentration of income.' Thanks, Alan! Having shipped so many good jobs overseas, we now find that U.S. workers who acquire job skills are overpaid!"

Every new legal immigrant increases demand on infrastructure. and in turn, new demands for even more immigrants. And more illegal aliens. The insatiable hunger of business only results in more oil consumption, rapid depletion of our natural resources, increasingly crowded highways, shopping centers, national parks. More taxes and more consumers of government services. More, more, more. What do you get with each new arrival? Congestion, pollution, demands for more mining, coal plants, nuclear plants and the drilling of ANWR. You cannot decrease energy demands by increasing immigration. You cannot decrease reliance on foreign oil by tolerating 20 million illegal aliens. The trade deficit worsens with each new consumer/immigrant foisted upon the American People. There is a natural balance that should be respected regarding available resources, whether it be food, water, oil, or human resources. Greed has no respect for nature, no respect for balanced economic models, and no respect for human beings. No respect for the consequences.

Let's face the facts, the majority of H-1B visa holders possess no special skills that their American counterparts lack... They are desired because they come CHEAP... The average H-1B foreign worker is paid 20 percent less than a comparably qualified American Worker.

The reported wages for 84 percent of H-1B workers were below the median U.S. wage, and 51 percent were in the bottom 25th percentile of U.S. wages.

H-1B is a big scam... It`s nothing more than cheap foreign labor, for greedy big business.

During my two years in a top MBA program, I had the chance to ask Bill Gates a question on this subject. I did so in an auditorium full of people when Gates came to talk about the future of technology, and at the time, there were some press reports on the threat India and China posed to U.S. software companies floating about. So I asked him what sort of risks global technology and cheap programming labor posed to Microsoft. Afterwards, classmates complimented me on the question and several couldn't understand his answer.

Bill Gates said he has trouble finding management talent because few people "think through the loop." He said cheap programmers "benefit me," so why should he care? This was a revealing admission. In other words, Bill Gates holds a worldview in which everything loops back TO HIM and the American people will dutifully protect his monopoly and franchise through our legal system, military, diplomacy and the like. He's rich, he owns the company, and he gets anything he wants. Anyone who sees it differently "doesn't get it."

But Congress is supposed to represent the national interest and the American people, and our representatives don't have to agree with a national policy built around Bill Gates's personal interests. Congress must think about a broader "loop" that includes the national interest, including our ability to service the national debt by having full employment.

Microsoft is recognized within the IT community as a company that does not innovate. Instead of innovating, they use their Windows monopoly to acquire innovators, and in the case of Netscape, even squash them. Meanwhile, Apple Computer, a company whose stock has soared while Microsoft's languished, is an innovator, yet doesn't beg Congress for H1-B visas. Sure, Apple does import select foreign workers, but nothing on the scale of this unwise and undemocratic bill.

Two House members, Gabrielle Giffords of Arizona and Lamar Smith of Texas, have introduced bills that would double or triple the number of H1B workers that are currently being brought in.

If either of these bills passes, there will be massive layoffs to make way for the new wave of job thieves. Then the new H1B people will all feel entitled to green cards. Should these foreigners get green card sponsorship, then you can expect more fake job ads and bad faith interviews of American job applicants, all done in order to game the Dept. of Labor regulations for green card sponsorship.

Anyone who has seen the infamous *How not to Hire an American* video on YouTube knows exactly what I am talking about. In this video, immigration attorneys from Cohen & Grigsby explain how they assist employers in running bad faith recruiting scams with the goal of NOT finding any qualified applicants, and the steps they go through to disqualify even the most qualified Americans in order to secure green cards for H1B workers who are ALREADY WORKING IN THOSE ADVERTISED JOBS. In these cases, the American job seekers are not even told that the job ads and interviews are part of a Labor Certification process for green card sponsorship, thus they are being defrauded without their knowledge or consent.

I think the laws should be changed so companies would have to use employment agencies instead of getting H1Bs. Hudson in Chicago got me a cool fun job that paid $25 per hour. If anyone is foolish enough to think there's not enough talent right here. I can find qualified applicants in less than an hour.. Problem solved.

Hey Boreal, for me the fight is as much about shutting down the employment green card program as it is about shutting down H1B. I have seen sickening levels of workplace discrimination against American professionals brought about by former H1B people who received their green cards for legal permanent resident status and then moved into management.

Yes, I do call/fax/email my so-called elected representatives regularly about these topics. But they do not listen to me, they only listen to the corporate elites like Bill Gates who want to want to get even richer by flooding this country with low wage third world labor.

Boreal, if you have not gotten your green card yet, then I hope you never do. We have enough obnoxious foreigners as permanent residents in this country. We don’t need any more.

I think the comments regarding the problems caused by the employment based green card program (fraudulent recruiting practices, etc) are well taken and should be explored in more depth by patriotic immigration reform organizations.

On a personal note, I have suffered personally and professionally from H-1B program as well as from the onslaught of illegal aliens. I have had my identity stolen (twice) by illegal aliens. I also suffered job loss and wage suppression due to the three year expansion of the H-1B program in the early part of this decade. As bad as the identity thefts were, the job losses and wage suppression (related to H-1B) were even more difficult for me to overcome. I eventually had to retrain myself (at great expense) and change professions. This involved taking a big pay cut from my previous income level.

The problems that the H-1B and L-1 visa programs cause for American citizens are usually ignored by the corporate media companies, who are all too quick to circulate phony stories about shortages of skilled American workers.

Thank you, Dan Stein, for (once again) standing up for the American worker on this issue. Because of your involvement in this vital issue, I will continue to support FAIR with my financial contributions, and I will encourage others to do the same.

Only 65000 H1B visas are issued every year and needless to say that is like a mere drop in the ocean in the American labor market.....

Doesn't the author of the article realizes that data entry, software programming jobs have already left for overseas.....

It would help if you ignorant fools stop thinking that a high school graduate with HTML and JAVA getting paid $200,000 p.a. for writing 4 lines of code in day.

Y2K is over, programming languages are getting smarter and just to let you ignorant morons know that engineering jobs are still here, will continue to be here.

Anybody who has an engineering degree from a reputed American university cannot be unemployed in the engineering sector unless that individual voluntarily does so.

Chinese and Indians work hard and are the next set of immigrants which are going to take America in the next century. So just suck it up and accept the fact that you have taken life for granted and just did not work hard enough.

For the record I have a MS in ELEC ENGG and I am working on a revolutionary attitude and air data system for the past 3 years. We are about 6 months away from production and already we have orders worth 5.5 million lined up from international aerospace giants like Bell, Augusta Westland and Bayou. I started working with a start up and am proud to say that along with my peers (who again are international graduate students) have managed to create wealth and jobs in this country.

All Congress needs to do is require businesses to pay a $500/hour minimum wage to non-citizens (refugees exempted); and require businesses to account for off-shore work at a $1-trilion income per project rate (meaning their income for federal income tax purposes will exceed $1-trillion). In my mind, that is fair & reasonable.

I used high numbers - but my point is Congress can stop this madness very simply - but until they act, it will be business-as-usual for US workers (which means millions upon millions of US workers will be screwed every day by big-business).

I have read these comments... and believe me, I feel the pain. Where I work, I am in the minority. 85%+ of the people that I see are NOT from the US! My spell checker goes off CONSTANTLY... and it's not because I don't know how to spell... :-)

I worked at Seagate up til 2002 when I was layed off. Seagate KEPT IT'S H1B people though. I have been to "token" interviews too! I have over 40 years of Computing experience on a wide number of platforms and Operating systems... and am quite good at what I do... and still have a hard time finding work.

To me this Seagate incident shows what big business is all about. $$$! I saw a program on the sundance channel about Corporations. They had an FBI profiler there who profiled a "typical" Corporation. The end result was labeled a sociopath.

This is who is running our country... They sit back and pull the strings and our "elected" representatives move.

I belong to other "organizations" for various things and have started adding this to my emails:

"Remember this well! If you don't take care of your constituents, WE WILL TAKE care of you at the polls!"

Is it doing any good? Who knows. We have to try though, don't we? Let's start a campaign with this as a slogan?

I was called the other day by a campaign worker soliciting a donation to a particular politician. I told her that I COMPLETELY disagreed with what her representative was doing in Washington and that I would vote Republican before I voted for her representative again.

This happened several months ago and I have recieved NO further solicitations. Interesting?

What I find troubling about the previous conversation is that no one is taking our businesses (e.g. Microsoft, Oracle, etc) or politicians to task on this issue. H1B Visas should not be issued for the bulk of people using them. Many that I have worked with have no better education than their American counterparts. If Americans don't have the education, then the businesses should export the work, not import the workers, exacerbating our overpopulation problems. What solutions are our politicians putting forth on behalf of their constituents to remedy this? Are American students who study Engineering, Technology or Programming getting their education subsidized? This should be the case. H1Bs should be for 2 years, then go home because we have grown our own talent. It's not fair that American students cannot afford tuition, yet a lot of foreign students here are subsidized. What people need to do is look at the long-range issues. In particular, chain migration allows immigrants in this country to bring in their entire family without consideration to what they contribute. If we didn't allow chain immigration we wouldn't get a lot of elderly family members coming in as well. America should adopt a policy that looks at immigrants below a certain age, only if they can contribute to this country. Elderly parents can be supported in their home country without overburdening our current inept infrastructure. Arranged marriages among Indians are also a pet peeve of mine. If you come to this country, BE AMERICAN. We should not allow this backward custom to come here because it makes us (US) go backwards as well.

Prince William, Va. Raid Targets Construction Firm

"Federal immigration authorities converged on a Prince William County construction company just before sunrise yesterday, arresting 34 Latin American nationals for being in the country illegally. Workplace raids are rare in the Washington area, and the roundup at CMC Concrete Construction in the Manassas area appears to be the largest in the region in nearly two years, according to a review of news releases on the U.S. Immigration and Customs Enforcement Web site," the Washington Post reported. "The workers -- who come from Guatemala, Mexico, Honduras, Costa Rica and El Salvador -- are being charged administratively and are in ICE custody undergoing deportation proceedings, said Ernestine Fobbs, a spokeswoman for the customs agency."

It is hard work, the construction companies have been making a killing underpaying illega aliens and yet the prices have not gone down. Los Angeles "authorities" have just discovered, Duh, that the car washes in the area have been paying illegal aliens as little as 3 dollars an hour. I'm a heavy equipment operator in Florida and can tell you first hand, I have been competing for jobs with these criminal aliens. Work has slowed down a lot and the wages are steady dropping. They work so cheap that employers actually train them for long periods of time. I've called ICE so many times, That's a joke.
Organized crime with politicians as the top crime bosses!
Eventually, everyone, everywhere will get hit as they dig deeper and deeper into society.
Farm workers???
Maybe for a few weeks they'll work the feilds then move on. We don't have 20 million working the feilds.
What a joke.

New Jersey Police Double Illegal Alien Arrests

"Seven months after the state attorney general, Anne Milgram, ordered local police departments in New Jersey to question people they arrest for certain crimes about their immigration status and to report illegal immigrants to federal authorities, the rate of such referrals has nearly doubled. But immigrants and their advocates say that some people have been unfairly swept up in the dragnet because of overzealous enforcement or confusion over how Ms. Milgram’s directive was supposed to be implemented, creating a chilling effect on some immigrants’ relationships with the police," the New York Times reports. "The directive was announced last August amid outrage after a triple murder in which one of the suspects was an illegal immigrant who had been released on bail after previous arrests. It urged officers to inquire about citizenship and nationality when booking people for felonies or drunken driving."

It is incredible ,that companies can find workers in America , especially , that their is more than 200 millions people in America , yes , I know the total is 300 millions, but you discount 50 millions illegals and 50 millions childrens ,the remainer is 200 millions . So my point is , there is alot of people in America to be looking out side of our nation. The reason , they are looking outside our nations is because they want cheap labor ,to enrich their pockets...

Tomato Farmer Will Switch Crops, Says Guest Workers Needed

"Saying the nation's immigration system is broken, Pennsylvania's largest grower of fresh-to-market tomatoes announced Monday he will no longer produce the crop because he can't find enough workers to harvest it. Keith Eckel, 61, a fourth-generation farmer and the owner of Fred W. Eckel Sons Farms Inc., said he saw a dramatic decline last summer in the number of migrant workers who showed up to pick tomatoes at his 2,000-acre farm in northeastern Pennsylvania," the AP reports. "Eckel, who planted 2.2 million tomato plants last year, said he also will stop growing pumpkins and will plant half as much sweet corn as usual, resulting in a loss of nearly 175 jobs. Eckel, one of the largest growers of fresh tomatoes in the Northeast, said it cost him $1.5 million to $2 million to plant and harvest a tomato crop -- too much of an investment to risk not having enough workers at harvest time."

B.S. and if they really need guest workers, it must be on a temporary basis, with no drain on the American taxpayer. In other words, like in every other nation that uses guest workers, when the job is done, you go home at your expense or the farmers, or the Archer Daniels Midland Corporation, whatever the case may be.

Failure to plan is a personal problem, not a failure of immigration laws. And migrant workers don't just 'show up', unless they are the illegal variety. You must file a request, and you have to pay minimum wage with benefits. As there are unlimited H2A agricultural 'temp worker' visas available, guess Fred is too lazy to file the form, or just too cheap to pay for legal workers.

I totally agree with impeachbush comment , it would be a good summer or permanent jobs for the welfare Queens and the Gangbangers ,who have nothing to do in summer time or the rest of the years ... There are plenty of workers in America , if you just know were to look at.. The welfare Queens and Gangbanger have no right to protest about working , since we the tax payer support them , and we need results from our money invested ,having them work the fields will reduce our crops.. It is a two way win , The farmers get a cheap labor ,for these people still get their Welfare checks , and We the tax payers get our produce cheap in a way and keep the criminals alway from our neighborhoods and from jails , for it is a big burned to support them in jails .. it is a win win situation....

I've read they are developing machines that will harvest tomatoes so why is it he can afford millions to plant tomatoes but can't afford to invest in and buy the automation machines to harvest them?

Remember the Spotted Owl? They were so endangered because they were cutting "old growth" trees and they were "the only habitat of the Spotted Owl".

Guess what? We cut the old growth forests and the Spotted Owl found new habitat and now calls other trees "home".

The jaguar would do the same. Animals are much more versitile than we, as humans, give them credit for. They can adapt extremely well.

We need to protect our borders and not the jaguar.

Perhaps Ms. McCain (any relations to John?) should first start with the Mexico People. I would say the bullets are doing more damaged to the Jaguars in Mexico than the fence:

While the goals and ambition of your organization to protect the jaguar is noble your using illegal immigration as part of your political agenda is unacceptable.

As you know the main enemies and endangerment to Jaguars are a rapid human population growth and hunting. Jaguar’s main problems are bullets and the destruction of their habitat from farmers, ranchers, and poachers.

The jaguars are endangered because it is hunted for its fur, and farmers kill the jaguar because it killed their cattle. Mexican ranches retain a 'tiger hunter' to kill them. Poaching by hunters is still a problem today as there is a great demand for their coats is running high where importation to countries is not prohibited. Hunting for Jaguar has become a high priced Sport (see www.huntjaguar.com). Hunters pay high dollars to track the Jaguar as a trophy animal in Mexico.

The enemy of the Jaguar is not a border fence. The few Jaguars that do cross into the United States for breeding will find a new habitat. Animals are much more versatile then we give them credit for.

True conservation of the Jaguar starts with solving the issue of poaching and destruction of the Jaguar's habitat from farmers and ranchers. There are far MORE Jaguars dying from bullets than there are from a border fence. I am sure your organization can find creative ways to help the Jaguar; rather than using illegal immigration and a border fence as a political agenda of your organization.
