Barletta Testifies in Hazleton Trial

"Hazleton Mayor Louis Barletta testified yesterday that his city needs another 30 police officers, but his crime-fighting priority has been creating laws to kick illegal immigrants out of town. During five hours on the witness stand, Mr. Barletta said Hazleton is being ruined by violent crime, crowded schools and a clogged emergency room at the city's private hospital. He attributed many of the problems to what he called 'illegal aliens,' even though he admitted he had no idea how many such immigrants are in his city," the Pittsburgh Post-Gazette reports. "Mr. Barletta said the ordinances are necessary to stop crime. Mr. Walczak jumped on the comment, telling the mayor it was unrealistic to believe crime could be eliminated. 'Especially when you're trying to do it and you're sued,' Mr. Barletta said." WFMZ-TV has a video report on yesterday's testimony as well.

The ACLU should change its name to SCUM, because that's what they are. Anti-American, self-appointed, bleeding heart SCUM! Numbers or not, we all know that illegals are draining our resources and also committing crime. A man was shot in the face by an ILLEGAL ALIEN, i.e. someone who has no right being here in the first place. We don't need more statistics. Even one number under those circumstances is enough and the culprits should be deported. Go to hell, ACLU!

Does not look good for Mayor Louis Barletta. You don't go into any court under an assumption, and I am surprised that his attorneys would have agreed to this trial will such little factual information in hand. Not only will the ACLU win this case but they will use this as an example to discredit the efforts of communities across this country who are battling mass illegal migration.

Well, now CNN's Senior Legal Analyst Jeffrey Toobin does join me.

And I -- I have to say if this isn't the silliest bunch of nonsense I have ever seen. Not speaking as a lawyer, that's your job, but this is ignorance at its most rampant best.

JEFFREY TOOBIN, CNN SR. LEGLA ANALYST: Well, there really is a delicious irony at the part -- on the part of the plaintiffs in this case. They're saying that this whole subject, illegal immigration, anything related to migration across borders, is entirely the responsibility of the federal government. But the reason Hazleton passed the law, in the first place, is the view of the majority of the Hazleton city council that the federal government has failed so dramatically to --

DOBBS: This is -- this is why I say it's such ignorance. What I would love to see is the town's attorneys hold up that sound byte from President Felipe Calderon of Mexico saying he wants open borders. He doesn't care what the federal -- U.S. federal law is. He has a sense of entitlement, just as do most of the people who are emigrating into this country illegally. And most of those idiotic organizations, who don't see any point beyond the narrow interests that they're pursuing.

How -- how close is this case, in your judgment?

TOOBIN: You know what, I think -- it may be an idiotic argument, but it may be a winning argument.

DOBBS: That's the nature of law.

TOOBIN: That's right. Federal courts are very reluctant to let localities trample on what they regard as federal sovereignty. Federal judges believe in federal law --

DOBBS: Let's go back here. How close do you think this is? Do you think this judge has enough existing law to make a determination in case law -- to make a determination that yes, a community in this country has a right when the federal government fails to enforce the laws that it's passing to defend itself against detrimental effects of illegal immigration.

TOOBIN: Well, it is true that just because a subject is also dealt with in federal law, it doesn't mean that localities can't deal with it at all. Just to take an easy example, minimum wage. There's a federal minimum wage, but there's nothing stopping states from raising their minimum wages higher.

DOBBS: Right.

TOOBIN: Which is something many states have done. That's essentially the argument here. Is that this argument -- that the Hazleton is simply adding to, not conflicting with, federal law.

DOBBS: Absolutely. And shouldn't that be persuasive at least as a legal argument whether or not this specific case meets the test, whatever those tests are?

TOOBIN: The problem is that immigration is not like -- not like --

DOBBS: It's hard to find an exact analog.

TOOBIN: It's hard to find an exact analog. And I think it's a tough case. A lot will depend on what the judge really thinks is going on here. Whether he thinks this is good faith --

DOBBS: ...for the judge. Can I tell you what's going on here? Corporate America is trying to have its way in court, in our workplaces, in our Congress, and take away every possible right from a middle class that's under assault by every special interest group in this country.

Did you hear me, judge? I don't know if that's intrusive into the process, the legal process, but that's what's going on.

DOBBS: Unbelievable. The shame is that a community has to go through this. A raid against the U.S. Chamber of Commerce, the ACLU, Pennsylvania ACLU. Big law firms. The Puerto Rican Legal Defense Fund. It just gets better and better. It must be kind of important.

TOOBIN: And the president of Guatemala was even mentioned in court today.

DOBBS: When you get NAFTA, I mean, my goodness, we wouldn't want to have a community in this country do anything without checking in with Guatemala, Mexico, or maybe Romania, check in with Vladimir Putin.

The problem with the "melting pot" idea is that it is just an idea. a pretty idea maybe. an enobling idea maybe, but nonetheless, just an idea.
It is interchangable with the "glorious tapestry" idea, and a small bundle of other rough woven thoughts by wooly headed ideologues.
More importantly, "melting pot" idea is an after the fact impressionistic notion-not a formal and substantive set of convictions, such as LAW.
To say it another way, OUR ancestors had no intention whatsoever of building a world out of a rather mediocre analogy.
Even if we assume that the melting pot idea carried the force of law, we would have to abide by all laws that issue from the (~idea), therefore:
Too many cooks spoil the broth
Too many disparate ingredients a foul soup maketh
Some "ingredients" love themselves too much, and like to remain unmixed like clumps, or "nuggets"
Usually those nuggets dont know the difference between a pot you cook in and...a pot you leave "nuggets" in.
perhaps "fat" nuggets.

Currently, the United States is only a cauldron of unstable chemicals waiting to explode.
It is the love of analogy over true though which will be the final cause of this.

HEY FAT MAN, WHAT PART OF "OVERPOPULATION" CAN YOU NOT UNDERSTAND?

Almost all EDUCATED demographers have said America was over-full at 200,000,000 and now we have 300,000,000 with more of your brainless (uneducated?) buddies wanting it to reach 400,000,000 in a decade or two.

We should have froze American immigration decades ago, but doing it now at least keeps the destruction from getting even worse.

By the way Fat Man, most of the folks the age of Mayor Barletta (50-60) were the American Baby Boom generation. We, unlike the typical mass of immigration you want to OVERPOPULATE America with, kept our child birth WAY DOWN to depopulate America the last several decades.

I'd like to point out 2 passages from the US Constitution:
"Section 4
The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion;.."

Clearly if the Federal government does not protect the States from invasion, they have the perogative/obligation to do this themselves under the 10th Amendment

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

The Hazelton Mayor is a legal US citizen.

Mayor Villaraigosa pretty much supports all that is Mexican, but their hasn't been enough furor over his antics.

Stop living in the past yourself and quit bringing up historical stuff like slavery and Europeans coming to North America.

An America has been from day one mostly one race, one language and still is. And one culture dominates all the rest. There are other races, cultures, etc. but they are a relatively small percentage of the total.

Note: the concept of the "melting pot" is based upon legal honor and respect (and duty in abiding by) our U.S. Constitution.

The Constitution makes clear that illegal aliens in our nation are in violation of laws (several) and that the penalty for that is deportation.

All the legal immigrants are a part of the "melting pot." The people who lie, cheat, sneak and steal their way here and/or remain here by lying, cheating, etc. are the criminal element and based upon their own choices and elected behaviors, they declare themselves to be apart from us as a nation.

Anyone who sincerely wants U.S. citizenship and is here illegally, go home, apply for legal immigration and do what's required to meet the requirements. If you fail to meet the requiremens, you are not welcome in the U.S.

a trip to southern california would be a good education for people who think mass immigration is good. we lock our doors and fence in our properties ( I'll bet even the aclu lawyers do) why is controlling who comes into our country wrong. every country I've traveled to I've needed a passport and visa. can't get a hotel without it. only in america. sneak in and set up housekeeping and tell the citizenry to go back to europe and then the "president" applauds them as heroes. go figure

It is all about work. Plain and simple. We want cheap products and services and this is what we get.
You go to other countries that do not have these problems and you get a society that owns very little products. No Ambrecromie, no iPods, no plethora of breakfast cereals and ect. I am a capitalist and not a Union Marxist. I live in a region of the country that is crying for workers, however the work is hard and very 19th century. The pay is equitable for talent needed. The labor market that I am referring to is Farm work. Farmers in my region do not have the manpower for the work required. If "red blooded Americans" would be enticed to work in the fields, they would not do it for no less than $20 per hour. This translates to $2-$3 tomatoes, $12 watermelons. This is fact. Farms are closing down because of this and more products are being harvested in South America. What is the root of the problem? American lack of "go-get-em". We want cush jobs and high wages. Our work force drove the manufacturers out of the US. I own a medium sized factory, which I will soon move out of the US. My profits are being eaten up by : High expected wages, High workmen's comp ( my crew claim a lot of questionable claims like: Carpal-tunnel and back problems from sitting too much ). I have a lot of no shows for work, and
many "day off " requests. I am doing the paperwork to move operations south. I expect a double in profits that my investors would appreciate. I do not want to do this, but it is must.
ps- the comment from the engineer guy about milk is like this: Milk is a loss leader and stores do not profit from this item. The $2.45 gallon is sold at cost, where as the $1.95 is less than cost and the store losses money to bring you in to the store.

Fat man, from you last post, you sound just like some native americans are using that support illegals mexicans. I hope that is not the case. I am native america and I cannot believe that anyone wants people who enter the country without regard to laws in the country. We have worked hard to gain the rights that we have and part of that is by obeying the laws and ensuring that we teach our children right and wrong. Many of us work with our tribes to ensure that our children have education and we have used federal aid at times to do this. Illegals will take the jobs that our families need and reduce the education that we want and need. In addition, water is getting harder to find in the southwest and why should we have to give water to illegals.
